1. This Flake/Benefit promotion (the "Promotion") is only open to entrants aged 16 and over and resident in the UK, Isle of Man or Channel Islands. Directors, management and employees (and the immediate families of directors, management and employees) of the Promoter or the agencies or companies associated with this Promotion are ineligible to enter. By entering this promotion all participants will be deemed to have accepted and be bound by these terms and conditions. All entry instructions form part of these terms and conditions.
2. No purchase necessary option available for Northern Ireland residents only: to enter, send your name and address to Flake lipstick promotion, P O Box 1079, Hemel Hempstead, HP1 1GY reaching the address on or before 31st October 2010. No bulk or third party entries accepted. A promotional pack will be opened on your behalf, and winners only will be informed by post that they have won. Please note that the Promoter cannot take responsibility for mail lost in the post. Proof of posting is not proof of receipt.
3. The Promotion starts, and codes are valid from, noon on 11 February 2010, and the promotion ends, and codes expire at, midnight on 31 October 2010 (the “Promotion Period”). Thereafter, all unredeemed codes will be invalid and cannot be redeemed with this or any other promotion.
4. A 10 character code is printed on the inside of each promotional Cadbury Flake wrapper. The promotion is carried on all promotional single bar wrappers, and on each bar wrap within promotional 5 and 9 bar promotional multipacks. All codes are unique and can only be used to enter the promotion once. From the total pool of unique codes, 1,000,000 winning codes have been randomly selected. Winners should retain winning wraps and may be asked to provide these to the Promoter as evidence.
5. The prize fund consists of 1,000,000 individual prizes available to be won during the Promotion Period, each prize consisting of BENEFIT lip product. Winners can select one lip product per winning code from the following Benefit range: Lipsticks, one of 'La La Land', 'Do Tell', 'Wild Card' or 'Flirt Alert'); or Lip gloss, one of 'Life on the A list' or 'Fresh Squeezed'. If a chosen colour choice is not available winners will be asked to select an alternative colour from the choices mentioned above. If none of the above colours become available an alternative range of Benefit lipstick colours will be offered for the winners selection (these products will be of equal or greater value).
6. First entry requires online registration at flake.co.uk (when the entrant will be required to enter their name, date of birth, email address and mobile number (please note, any subsequent text entries must be sent from the mobile number as registered by the entrant) then code submission online or by text to 68600 (from UK) or 07797800680 (from CI and IOM). In each case standard operator charges apply but may not be included in pre-paid packages.

8. Entries with incomplete or invalid information will not be accepted as valid entries into the promotion.
9. Unless entrants expressly agree otherwise at point of registration, personal details will be used for no other purpose than for entry into the draw. The Promoter may disclose entrants' personal information to its contractors and agents to assist in conducting this promotion or communicating with entrants. Please see the Promoter's privacy policy.
10. There is a limit of two entries per person per day using unique codes for each entry, whether entered online or by text.
11. Winners will be notified by an instant on-screen confirmation and email, or by SMS message (dependent on method of entry). Winners will be asked to submit their special unique winner's code and asked to select and claim their prize online via flake.co.uk. Full instructions on how to select and claim will be available on flake.co.uk. Winners should receive their confirmation notice within 24 hours of entry, but from time to time this may take longer due to operator traffic which is beyond The Promoter's control. The Promoter accepts no responsibility for any entries that are lost or delayed, or which are unable to be sent due to lack of network coverage, operator or network error, or for any other reason beyond its control.
12. All winning entrants require internet access and a valid e-mail address to claim their prize.
13. Only valid codes will be accepted. All codes are subject to verification and winners may be asked to show their winning pack.
14. If an entrant is unable to read their wrap code, or the code is incomplete, entrants should contact Cadbury Consumer Relations on 0121 451 4444 or Flake Lipstick promotion, Consumer Relations Department, Cadbury, PO BOX 12, Bournville, Birmingham, B30 2LU and send in the promotional wrap with their full name and contact details. The entrant will be provided an alternative code to enter the promotion with. Please note that the Promoter cannot take responsibility for mail lost in the post. Proof of posting is not proof of receipt.
15. Sending a text message or entering details online is not proof of receipt of entry.
16. All prizes will be delivered within 21 days of being claimed on-line at www.flake.co.uk.
17. No cash or other alternative prizes are available, except that in the event of circumstances outside of its control, The Promoter reserves the right to award similar prizes of equal or greater value.
18. The total number of winners will be confirmed on www.flake.co.uk after 1st November 2010.
19. In the event of a mobile phone being lost, stolen or damaged the Promoter is unable to retrieve or transfer any existing entries to a new mobile number.
20. If prize items do not arrive in a satisfactory condition, participants have up to 28 days to contact Cadbury Consumer Relations on 0121 451 4444 or Flake Lipstick promotion, Consumer Relations Department, Cadbury, PO BOX 12, Bournville, Birmingham, B30 2LU quoting 'Flake' Promotion to request a replacement. BT customers will pay no more than 5p per minute for calls to this number. Other providers charges may vary. In the absence of such notification the participant will be deemed to have accepted all items. Items correctly supplied in accordance with the claim cannot be exchanged unless found on first use to be defective.
21. The Promoter accepts no liability for system failures at the handling house, on websites or for text entry or on telephone hotlines. Neither can the Promoter be held responsible for the failure to fulfil the obligations of any of the third parties involved in this Promotion, although the Promoter will always endeavour to minimise the effect on entrants of any such failure.
22. The Promoter accepts no liability for damage / injury to persons, their mobile phones or their computers resulting from any attempt to access Flake.co.uk or participate in the promotion.
23. If there is any reason to believe that there has been a breach of these terms and conditions, or in the spirit of the promotion, The Promoter may, at its sole discretion refuse to process a claim. The Promoter will be the final arbiter in any decisions and these will be final and binding and no correspondence will be entered into.
24. Deliberate attempts to enter the same code more than once or the use of promotional codes not intended for use in this promotion and infringement of these terms and conditions.
25. Winners agree to take part for free in any publicity for the Promotion that may be organised by the Promoter.

27. The Promoter reserves the right to cancel, amend, terminate or temporarily suspend this competition at any time with no liability to any entrant or any third party.
